Welcome to Africa Nature Tours and Safaris Ltd. These Terms & Conditions govern the use of our website and the booking or purchase of our tours, holidays, excursions, accommodation, transport, and other travel-related services.

By making an enquiry, requesting a quotation, making a booking, or using our services, you agree to these Terms & Conditions.

Africa Nature Tours and Safaris Ltd provides travel and tourism services, including tours, beach holidays, excursions, travel packages, accommodation arrangements, transportation, and other travel-related experiences.

Our services may be provided directly by us or through independent third-party suppliers, including hotels, lodges, camps, transport operators, guides, activity providers, and other travel service providers.

All enquiries are subject to availability. A quotation provided by us may include some or all of the following:

• Accommodation
• Transportation
• Tours and excursions
• Activities
• Meals
• Park or attraction fees
• Guide services
• Other services specifically stated in the quotation

Unless otherwise stated, a quotation is not a confirmed booking.Prices may change before a booking is confirmed due to changes in supplier prices, availability, exchange rates, government fees, taxes, park fees, or other circumstances beyond our control.

A booking becomes confirmed only after we have received the required information and payment or deposit specified in the quotation or booking confirmation.

The booking confirmation will contain the applicable details, including services booked, dates, prices, payment requirements, and other relevant conditions.

You should carefully check the booking confirmation and notify us immediately if any information is incorrect.

Payment terms will be communicated at the time of booking. Depending on the service, we may require:

• A deposit to confirm the booking; and/or
• Full payment before the date of travel.

A booking may not be considered confirmed until the required payment has been received. Failure to make payment within the agreed period may result in cancellation of the booking and loss of availability.

Unless otherwise stated, prices are based on the services and arrangements specified in the quotation. Prices may be affected by changes in:

• Accommodation rates
• Transport costs
• Fuel prices
• Government taxes or charges
• Park and conservation fees
• Exchange rates
• Supplier charges
• Airline or other transportation charges

Any applicable additional costs will be communicated to the traveller where reasonably possible.

If you need to cancel a booking, you must notify us as soon as possible in writing. Cancellation charges may apply depending on:

• How much notice is provided;
• The accommodation or service provider’s cancellation policy;
• The date of travel;
• Whether tickets or services have already been purchased;
• Any non-refundable deposits or payments.

Any refund will be calculated after deducting applicable cancellation charges and non-refundable amounts. The specific cancellation conditions applicable to your booking will be communicated during the booking process.

We reserve the right to make reasonable changes to an itinerary, accommodation, transportation, activities, or other arrangements where necessary due to circumstances such as availability, weather, safety, operational requirements, supplier changes, or other events beyond our reasonable control.

Where a significant change is necessary, we will make reasonable efforts to provide a suitable alternative.

If we are required to cancel a booking, any refund or alternative arrangement will be handled in accordance with the applicable booking terms and the circumstances of the cancellation.

We strongly recommend that all travellers obtain suitable travel insurance before travelling. Travel insurance should provide appropriate cover for circumstances such as:

• Medical emergencies
• Trip cancellation
• Trip interruption
• Lost or damaged baggage
• Personal accidents
• Travel delays
• Emergency evacuation

Travellers are responsible for checking that their insurance provides adequate coverage for their specific trip and activities.

Accommodation is subject to availability and may be provided by third-party hotels, lodges, camps, villas, resorts, or other accommodation providers.

Room types, facilities, meal plans, check-in times, and other conditions are subject to the individual property’s policies.

Where the accommodation originally selected becomes unavailable, we may arrange a suitable alternative of a similar standard where reasonably possible.

Transportation may be provided by us or by independent transport providers. Vehicle types may vary depending on availability, destination, road conditions, group size, and operational requirements.Travel times provided in itineraries are estimates and may be affected by traffic, weather, road conditions, border procedures, or other circumstances.

Some of our tours and activities involve wildlife, outdoor environments, water activities, roads, uneven terrain, or other inherent risks. Travellers are expected to follow the instructions of guides, drivers, accommodation staff, park authorities, and activity providers.

Wildlife sightings cannot be guaranteed. Africa Nature Tours and Safaris Ltd will not be responsible for a traveller’s failure to follow reasonable safety instructions.

Travellers are responsible for determining whether they are physically and medically able to participate in their chosen activities.

Travellers should inform us before travel of any relevant requirements that may reasonably affect the arrangements or activities.

Certain activities may have specific health, age, fitness, or safety requirements.

Travellers are responsible for their personal belongings, valuables, documents, electronic devices, luggage, and other possessions.

We recommend keeping valuable items secure and carrying appropriate insurance. We are not responsible for loss, theft, or damage to personal belongings except where liability cannot lawfully be excluded.

We shall not be liable for failure or delay in performing our obligations where this is caused by circumstances beyond our reasonable control.

Such circumstances may include:

• Natural disasters
• Severe weather
• Floods
• Fire
• Epidemics or pandemics
• Political unrest
• Civil disturbances
• War or terrorism
• Government restrictions
• Border closures
• Strikes
• Transport disruptions
• Road closures
• Changes in laws or regulations
• Other events beyond our reasonable control

Where possible, we will work with the traveller to find a reasonable alternative.

Some services included in your booking may be provided by independent third parties.

We carefully select service providers where reasonably possible, but their services are also subject to their own terms, conditions, availability, and operational requirements. We are not responsible for circumstances caused solely by the actions or omissions of an independent third-party provider, except where liability cannot legally be excluded.

We make reasonable efforts to ensure that information published on our website is accurate and up to date.

However, photographs, descriptions, itineraries, prices, availability, facilities, and other information may change. Website content should not be treated as a guarantee that a particular service, facility, activity, animal sighting, room, vehicle, or experience will be available at the time of travel.

You agree not to misuse our website or use it for unlawful purposes.

You must not:

• Attempt to gain unauthorized access to the website or its systems.
• Introduce malicious software or harmful code.

To the extent permitted by applicable law, Africa Nature Tours and Safaris Ltd shall not be liable for indirect, incidental, or consequential losses arising from circumstances beyond our reasonable control. Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by law.

We may update these Terms & Conditions from time to time to reflect changes in our services, business practices, or applicable legal requirements.  The updated version will be published on this page with a revised effective date.

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of Kenya.

Any dispute arising in connection with our services or these Terms & Conditions shall, where necessary, be subject to the applicable courts and legal processes of Kenya.
